Trainer Agreement

This Trainer Agreement applies to all trainers who sign up to and use the Trainer Trackr platform.

By creating an account or subscribing to Trainer Trackr, you agree to the terms below.

1. Independent Contractor Status

You acknowledge and agree that:

  • You operate as an independent professional
  • You are not an employee, agent, or representative of Trainer Trackr
  • Trainer Trackr does not control how you deliver your services

2. Responsibility for Services

You are solely responsible for:

  • All services you provide to clients
  • The quality, safety, and delivery of your services
  • Any advice, programs, or training you offer

Trainer Trackr does not supervise or control your services.

3. Qualifications & Compliance

You confirm that:

  • You hold all relevant qualifications required to provide your services
  • You comply with all applicable laws and industry standards
  • You operate within your scope of practice

You must ensure your qualifications remain valid at all times.

4. Insurance Requirements

You agree that:

  • You hold valid public liability insurance and/or professional indemnity insurance where applicable
  • You will maintain this insurance while using the platform

Trainer Trackr reserves the right to request proof of insurance at any time.

5. Liability & Indemnity

You agree that:

  • Trainer Trackr is not liable for any claims, injuries, losses, or damages arising from your services
  • You indemnify and hold Trainer Trackr harmless against any claims, disputes, or legal actions related to your services

This includes claims made by your clients or third parties.

6. Subscription & Payments

By subscribing to Trainer Trackr:

  • You agree to the selected subscription plan
  • Payments are billed as agreed at signup
  • Fees are non-refundable unless required by law
  • You may cancel your subscription before the next billing cycle

Failure to cancel before billing will result in the next charge being processed.

7. Profile & Content

You are responsible for:

  • Ensuring all information on your profile is accurate and not misleading
  • Keeping your profile updated

You grant Trainer Trackr permission to:

  • Use your name, images, and content
  • Promote your profile through marketing, advertising, and social media

8. Platform Conduct

You agree not to:

  • Misrepresent your qualifications or services
  • Engage in misleading or deceptive conduct
  • Damage the reputation of Trainer Trackr

You must act professionally at all times.

9. Client Relationships

All relationships and agreements between you and your clients are your responsibility.

Trainer Trackr is not responsible for:

  • Client disputes
  • Missed sessions
  • Refunds or service issues

10. Account Termination

Trainer Trackr reserves the right to:

  • Remove your profile at any time
  • Suspend or terminate your account
  • Refuse continued access to the platform

11. Changes to Agreement

We may update this Trainer Agreement at any time.

Continued use of the platform constitutes acceptance of any changes.

12. Governing Law

This Agreement is governed by the laws of Australia.
